These Terms of Service ("Terms") govern access to and use of the web application and associated WhatsApp notification services operated by Foster and Ince Cruise Services Inc. ("Foster and Ince Cruise Services", "we", "us", or "our").

By accessing or using the application, you agree to these Terms. If you are using the application on behalf of a tour company or other organization, you represent that you are authorized to do so on behalf of that organization.

1. About the Service

Foster and Ince Cruise Services Inc. is a cruise service agency based in Barbados that arranges tours and excursions on behalf of cruise ships and their passengers.

Foster and Ince Cruise Services operates a web application that assists with the operational coordination of these tours. The application enables authorized Foster and Ince Cruise Services personnel and approved tour-company personnel to coordinate with participating tour vendors and venues.

The application may use the WhatsApp Business Platform and email to send operational notifications to vendors and venues.

These notifications may communicate information such as:

  • The venue participating in the tour

  • The scheduled date and time of the visit

  • The number of adults expected

  • The number of children expected

  • The number of escorts expected

For example, a venue may receive a notification that 10 adults, 2 children and 1 escort are scheduled to attend at a particular date and time.

The application does not process or store individual guest or passenger information.

2. Authorized Use

Access to the application is restricted to:

  • Authorized employees and personnel of Foster and Ince Cruise Services Inc.; and

  • Authorized personnel of approved tour companies.

Users must only use the application for legitimate business and tour-operation purposes.

You must not:

  • Allow an unauthorized person to access your account.

  • Share your login credentials with another person.

  • Use the application for unlawful or fraudulent purposes.

  • Attempt to gain unauthorized access to the application, database, or related systems.

  • Interfere with the operation or security of the application.

  • Attempt to access information belonging to another organization or user without authorization.

  • Use the application to send spam, unsolicited advertising, or unrelated promotional communications.

  • Circumvent any security or access-control mechanism.

3. User Responsibilities

You are responsible for ensuring that information entered into or transmitted through the application is accurate and appropriate for its intended operational purpose.

Users are responsible for maintaining the confidentiality of their account credentials and for notifying Foster and Ince Cruise Services promptly if they believe their account has been compromised or accessed without authorization.

Users must comply with all applicable laws and regulations when using the application.

4. Vendor and Venue Communications

The application may send automated or manually initiated operational notifications to vendors and venues using WhatsApp or email.

These communications are intended to facilitate the delivery and coordination of scheduled tours.

Foster and Ince Cruise Services does not guarantee that a particular message will be delivered successfully. Delivery may be affected by factors outside Foster and Ince Cruise Services' control, including internet connectivity, WhatsApp availability, recipient account status, email delivery systems, or third-party service interruptions.

Users should not rely exclusively on an automated notification where separate confirmation of a tour booking or venue arrangement is required.

5. WhatsApp and Third-Party Services

Foster and Ince Cruise Services uses third-party services, including the WhatsApp Business Platform provided by Meta, to deliver certain communications.

Use of WhatsApp is also subject to WhatsApp's and Meta's applicable terms, policies, and requirements.

Foster and Ince Cruise Services does not control the availability, operation, or policies of third-party services and is not responsible for interruptions or changes to those services.

Other third-party services, including cloud hosting, database infrastructure, and email delivery services, may also be used to operate the application.

6. Data and Privacy

Foster and Ince Cruise Services handles personal information in accordance with its Privacy Policy.

The application may store vendor and venue contact information such as:

  • Business or venue name

  • Contact person's name

  • Email address

  • WhatsApp telephone number

The application does not process or store individual guest or passenger information. It uses aggregate attendance figures, such as the number of adults, children, and escorts, for operational notifications.

7. Intellectual Property

The application, including its software, design, interfaces, branding, content, and underlying technology, is owned by or licensed to Foster and Ince Cruise Services Inc. and is protected by applicable intellectual property laws.

Subject to these Terms, Foster and Ince Cruise Services grants authorized users a limited, non-exclusive, non-transferable right to access and use the application for legitimate business purposes.

Users may not copy, reproduce, modify, distribute, reverse engineer, sell, sublicense, or create derivative works from the application or its underlying technology except where expressly permitted by applicable law or with Foster and Ince Cruise Services' written permission.

8. Availability and Changes to the Service

Foster and Ince Cruise Services will make reasonable efforts to keep the application available and operational but does not guarantee uninterrupted or error-free availability.

Foster and Ince Cruise Services may:

  • Modify or improve the application.

  • Add, remove, or change features.

  • Temporarily suspend the service for maintenance or security reasons.

  • Discontinue portions of the service where necessary.

Where reasonably practicable, Foster and Ince Cruise Services may provide notice of significant changes or planned interruptions.

9. Suspension and Termination

Foster and Ince Cruise Services may suspend or terminate a user's access to the application if:

  • The user violates these Terms.

  • The user's access is no longer authorized.

  • The account presents a security risk.

  • The application is being used for unlawful or abusive purposes.

  • Suspension is necessary to protect Foster and Ince Cruise Services, its users, vendors, venues, or other parties.

Foster and Ince Cruise Services may also terminate access where the underlying relationship between Foster and Ince Cruise Services and the relevant tour company ends.

Upon termination, the user's right to access the application will cease.

10. Disclaimer

The application is provided to support Foster and Ince Cruise Services' tour coordination and notification activities.

While Foster and Ince Cruise Services takes reasonable steps to ensure that information provided through the application is accurate, Foster and Ince Cruise Services does not guarantee that all information will always be complete, current, or error-free.

Foster and Ince Cruise Services is not responsible for failures caused by circumstances outside its reasonable control, including failures of third-party communication services, internet infrastructure, telecommunications networks, or recipient systems.

11. Limitation of Liability

To the extent permitted by applicable law, Foster and Ince Cruise Services will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of, or inability to use, the application.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

12. Indemnification

To the extent permitted by applicable law, users and organizations using the application agree to indemnify and hold Foster and Ince Cruise Services Inc. harmless from claims, losses, damages, liabilities, and reasonable expenses arising from their misuse of the application, violation of these Terms, violation of applicable law, or unauthorized use of the service.

13. Confidentiality

Users may have access to operational information relating to Foster and Ince Cruise Services' tours, vendors, venues, schedules, and business activities.

Users must treat such information as confidential and must not disclose it to unauthorized third parties except where disclosure is required by law or is necessary for legitimate tour-operation purposes.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Barbados, without regard to its conflict-of-law principles.

Subject to any mandatory rights or protections that may apply under the laws of another jurisdiction, the courts of Barbados shall have jurisdiction over disputes arising out of or relating to these Terms or the use of the application.

15. Changes to These Terms

Foster and Ince Cruise Services may update these Terms from time to time.

When changes are made, the "Last updated" date at the beginning of the Terms will be revised. Continued use of the application following the effective date of updated Terms constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
